STAR TREE STUDIO

THE TERMS AND CONDITIONS APPLY TO YOUR BOOKING

THE TERMS AND CONDITIONS APPLY TO THIS BOOKING AND YOUR SIGNATURE/E-MAIL CONFIRMATION OR ATTENDANCE AT THE STUDIO ON THE SESSION DATES (AFTER RECEIPT OF THESE TERMS) CONFIRMS ACCEPTANCE.

TERMS AND CONDITIONS PAYMENT

Standard full day bookings consist of …hours, commencing at….. And finishing at… Overtime is chargeable at…. per hour,and payable within 48 hours after being incurred. Client agrees to pay the Studio Fee to StarTree Records Ltd (“StarTree”) within 5 days of the acceptance of this agreement. The booking is not confirmed until StarTree receives payment in full. If applicable, VAT is payable on top of all Studio Fees, equipment hire fees, expenses and other payments to be made to StarTree hereunder.

STUDIO SESSIONS Client shall comply with all studio policies and procedures implemented by StarTree from time to time. Smoking and drugs are not permitted in the studio in any circumstances. Client shall indemnify StarTree from all losses, expenses, costs and damages incurred by StarTree arising out of Client’s deliberate or negligent actions. Any technical requirements of the Client must be discussed with StarTree no less than 5 days in

advance of the Session Dates. StarTree can provide a list on request of its standard equipment available for hire. StarTree may provide a producer and/or mixer subject to a separate agreement.

StarTree’s staff shall be entitled to enter and remain at the studio during the Session Dates.

MASTERS The client’s access to the masters and session data materials is granted immediately upon settling StarTree’s invoice(s) linked to the session or any outstanding dues prior to the session.
EXPENSES Any costs incurred by StarTree on Client’s behalf (including without limitation sustenance, taxis, equipment hire) shall be reimbursed by Client to StarTree within 48 hours of being incurred.

THEFT / DAMAGES The client holds liability for any damages or theft that occur, or that can be ascribed to them, whether before, during, or after their session. It should be noted that StarTree Records Ltd, its staff, or Directors will not bear responsibility for the theft, loss, or damage of the client’s personal equipment and belongings at any point during or after the rental period.

BACKUPS and STORAGE • At the conclusion of a recording session, data and materials shall be held by Star-Tree for 10 days solely at the risk of the client, After 10 days from the end of a session, the client shall be liable for such reasonable charges as StarTree may raise against

the client for the continued storage of the materials,• StarTree is at no time responsible for the storage of session data or masters. StarTree shall be entitled to dispose of masters and session data if agreed with the client that they do not wish to have their session stored or backed-up. • It is strongly advised that the client supplies a portable HD storage device as an alternative to temporary storage.

CANCELLATION Cancellations made by Client within 7 days before the first Session Date will be charged at 50% of the full fee save that cancellations made by Client within 2 days before the first Session Date shall be charged at 100% of the full fee. StarTree reserves the right to cancel sessions at any time and 100% of the Studio Fee already paid shall be reimbursed to Client (less any expenses incurred by StarTree, or other sums due to StarTree) in such circumstances, unless StarTree has cancelled the session as a result of Client’s breach of this agreement, or Client’s breach of any of StarTree’s studio policies or procedures notified to Client in advance of the breach. Furthermore,• Invoices are payable in full in the event of a late cancellation. • Fees shall not be reduced on account of the client’s failure to use the studio for any or all of the period of the booking

CLIENT RESPONSIBILITY All equipment brought into the studio by or on behalf of the Client shall be at the Client’s risk. Client shall be solely responsible for handling, storage and transfer of any recording files and other data. StarTree shall not be liable for any delay or failure to perform their obligations under this agreement due to causes beyond its control. • When a booking is made, the client acknowledges and agrees that they, or their designated representatives, are responsible for ensuring that the StarTree studio is suitable for the client’s intended purpose. • Furthermore, the client affirms that their personal equipment will be in good working condition and compatible with the studio. • Any issues or damage arising from the use of the client’s personal equipment, including virus-related issues, will be solely the responsibility of the client and may incur associated charges • By agreeing to a studio booking, the individual initiating the reservation agrees to assume responsibility for settling any invoice connected to the booking. This responsibility remains regardless of whether they choose to designate a third party for invoicing. This agreement shall be governed by and construed in accordance with the laws of England, whose courts shall be the courts of exclusive jurisdiction.
